Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GeoTech Brain website, exam-preparation platform, practice tests, and related services (collectively, the "Service"). By creating an account, purchasing access, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 18 years old and capable of entering into a binding agreement. These Terms apply to all visitors, registered users, and subscribers.

2. Description of the Service

GeoTech Brain provides online study materials, practice questions, timed computer-based-test (CBT) simulations, performance analytics, and related learning tools for candidates preparing for the PE Civil Geotechnical examination.

3. Independent Platform / No Affiliation

GeoTech Brain is an independent exam-preparation platform. GeoTech Brain is not affiliated with, endorsed by, sponsored by, or approved by NCEES, any state licensing board, or any other exam administrator. NCEES and related marks belong to their respective owners.

4. Educational Use Only

The Service is provided for general educational and exam-preparation purposes only. It is not engineering advice, professional advice, legal advice, licensing advice, or a substitute for official exam rules, professional judgment, or review of primary references.

5. Accounts & Eligibility

• You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Accounts are for individual use only. Sharing, reselling, or providing access to your account to others is prohibited and may result in suspension.
• Notify us promptly of any unauthorized use of your account.

6. Payments, Access Duration & Refunds

• Paid plans grant access to specific features for the duration stated at checkout. Pricing and plan details are shown on our Pricing page.
• Payments are processed securely by our third-party payment provider, Stripe. We do not store your full card details on our servers.
• Access begins once payment is confirmed and continues until the end of the applicable access period.
• Refunds: Because the Service provides immediate access to digital content, requests are reviewed on a case-by-case basis. If you believe you are entitled to a refund, contact us within 7 days of purchase and we will work with you in good faith.
• We may change plan features or pricing prospectively; changes will not affect access you have already paid for.

7. Official Exam Rules

You are responsible for confirming current exam specifications, approved references, registration deadlines, calculator rules, identification requirements, and all other official exam policies directly with NCEES and your applicable licensing board. If GeoTech Brain content differs from official materials or rules, the official source controls.

8. Content Accuracy

We work to keep questions, solutions, references, and platform features accurate and useful, but errors, omissions, outdated references, typographical mistakes, or technical interruptions may occur. You should independently verify calculations, references, and study conclusions. If you identify a potential error, please contact us so we can review it.

9. User-Uploaded Materials

If the Service allows you to upload reference materials, you are responsible for ensuring you have the right to use those materials. Do not upload confidential, unlawful, infringing, or unauthorized content. Uploaded files are provided for your study workflow and are not reviewed by GeoTech Brain for legal, technical, or professional accuracy.

10. Acceptable Use

You agree not to:

• Copy, reproduce, distribute, scrape, or create derivative works from our questions, solutions, or other content;
• Share your account or content with non-subscribers;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Use the Service for any unlawful purpose.

11. Intellectual Property & Trademarks

All content on the Service — including questions, solutions, text, graphics, logos, and software — is owned by GeoTech Brain or its licensors and is protected by intellectual property laws. Your subscription grants you a limited, personal, non-transferable, non-exclusive license to access the content for your own exam preparation. No other rights are granted.

12. No Guarantee of Results

The Service is provided to help you prepare, but we do not guarantee that you will pass the PE Civil Geotechnical examination, improve your score, obtain licensure, or achieve any particular result. Your outcome depends on many factors outside our control, including your prior knowledge, study time, exam-day performance, and official exam content. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy of content.

13. Limitation of Liability

To the maximum extent permitted by law, GeoTech Brain and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm to us or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in California, unless applicable law requires otherwise.
